ICPC OPPOSES FRESH BAIL BID BY EL-RUFAI, COURT ADJOURNS HEARING TO MAY 13

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has formally opposed a renewed bail application filed by former Kaduna State governor, Nasir El-Rufai, as proceedings continued before the Kaduna State High Court.

At Tuesday’s resumed hearing, defence counsel, Ubong Akpang, notified the court of a fresh bail application, stressing that the matter directly concerns the defendant’s fundamental right to liberty. He maintained that all requisite legal processes had been duly filed and served, signalling readiness to proceed.

However, ICPC counsel, Ibrahim Mukhtar, told the court he had only just been served with the defendant’s further affidavit supporting the application. He requested additional time to review the new filings.

In response, the presiding judge, Justice D.H. Khobo, adjourned the matter to May 13, 2026, for the hearing of the bail application.

The development follows an earlier ruling in which the court denied bail to El-Rufai. Justice Khobo had held that the defence failed to submit a further affidavit countering the ICPC’s claims, which introduced new allegations.

Among the prosecution’s concerns were the likelihood of flight risk given the defendant’s influence and resources, alleged obstruction during an attempted arrest at the Nnamdi Azikiwe International Airport in Abuja, refusal to surrender travel documents and electronic devices, and the potential to interfere with witnesses and evidence.

The court holds that bail remains discretionary and must align with the interests of justice. It further ruled that the defendant’s status could compromise ongoing investigations, particularly as other suspects are still at large.

Justice Khobo also noted that El-Rufai did not challenge key elements of the prosecution’s affidavit, effectively deeming them admitted. Claims relating to health grounds were dismissed due to a lack of supporting evidence.

Consequently, the court ordered that the former governor remain in ICPC custody pending trial and directed an accelerated hearing of the case.

Despite the earlier ruling, the defence has proceeded with a fresh bail application, which the ICPC has now contested.

The Commission reiterated its commitment to due process and the diligent prosecution of corruption cases, assuring the public that justice will be pursued in accordance with the law.
