Former Venezuelan President Nicolás Maduro faces significant legal challenges in his attempt to have criminal charges against him dismissed by a United States court, according to legal experts.
Maduro’s defence team is expected to argue that the case should be thrown out, citing claims of immunity as a former head of state and raising questions over the circumstances surrounding his capture and transfer to the United States.
The former Venezuelan leader has pleaded not guilty to charges brought by US prosecutors, including allegations related to drug trafficking. His lawyers are expected to challenge the legality of the prosecution and argue that international law protections should apply in his case.
Legal analysts, however, said Maduro could face difficulties persuading the court to dismiss the case. They noted that previous US court decisions involving foreign leaders and defendants brought into the country under disputed circumstances have generally not resulted in criminal cases being dismissed.
The case is being handled by US District Judge Alvin Hellerstein in Manhattan. A key issue before the court is whether Maduro qualifies for immunity as a recognised head of state, with experts noting that US courts have historically considered the position of the executive branch when determining recognition of foreign leaders.
Maduro’s legal team has also questioned the circumstances of his capture, while prosecutors maintain that the charges are based on alleged criminal conduct linked to his time in power.
The proceedings are expected to test how US courts handle cases involving foreign leaders, claims of diplomatic immunity and allegations of violations of international law.
