The African Action Congress has sued President Bola Tinubu and the National Assembly over his alleged failure to formally transfer presidential powers to Vice-President Kashim Shettima during his extended vacation abroad.
The suit was filed at the Federal High Court in Abuja on Monday by the party through its National Legal Adviser, Inibehe Effiong.
The AAC is asking the court to determine whether Tinubu was constitutionally required to transmit a written declaration to the Senate President and Speaker of the House of Representatives before proceeding on vacation.
The party said Tinubu travelled out of Nigeria on August 30 and subsequently extended his vacation on September 21 without transmitting the declaration.
It is also challenging the alleged failure of the National Assembly to pass a resolution authorising Shettima to perform the functions of Acting President after Tinubu’s absence exceeded 21 days.
The party based its case on Section 145 of the 1999 Constitution, which provides for the temporary transfer of presidential functions to the Vice-President.
The AAC is seeking declarations that Tinubu’s alleged failure to transmit the required notice and the National Assembly’s failure to act after the specified period violated the Constitution.
It is also seeking a perpetual injunction restraining Tinubu from proceeding on future vacations without complying with the constitutional provisions governing the transfer of presidential functions.
The Attorney-General of the Federation, Senate President, Speaker of the House of Representatives and National Assembly were also joined as defendants in the suit.
The Presidency has maintained that Tinubu continued performing official duties while on his working vacation abroad.
No date has been fixed for hearing of the suit.
