Anthropic, an artificial intelligence lab, has filed a lawsuit to block the US Pentagon from placing it on a national security blacklist, escalating tensions over restrictions on the use of its AI technology. The move follows Anthropic’s refusal to remove safeguards preventing its AI from being used in autonomous weapons or domestic surveillance.

The company claims the Pentagon’s actions violate its constitutional rights, including free speech and due process, and warned that the designation could cost it billions in revenue and damage its reputation. The lawsuit seeks to reverse the designation and prevent federal agencies from enforcing it.

The dispute highlights the broader debate over government authority versus corporate control over AI applications, particularly in military contexts. Anthropic said it remains open to negotiations despite the lawsuit.

Support for Anthropic has come from a group of 37 AI researchers from OpenAI and Google, who filed an amicus brief, arguing that government blacklisting could stifle innovation and limit open debate on AI’s risks and benefits.

The Pentagon has not commented on the litigation, however maintains that AI restrictions could endanger US security, asserting its right to use AI for “any lawful purpose.” Meanwhile, the White House is reportedly preparing an executive order to remove Anthropic’s AI from federal operations.

This case could set a major precedent for how AI companies negotiate usage restrictions with the US government and how far the government can go in controlling commercial AI technologies.
