The United States Supreme Court has allowed the Trump administration to continue using an expanded federal citizenship-verification database for voter checks while a legal challenge to the system continues.
The court on Friday temporarily paused a lower-court order restricting the administration’s modified Systematic Alien Verification for Entitlements system, known as SAVE. The decision allows states to resume using the expanded system to check voter eligibility ahead of upcoming elections.
The ruling does not resolve the underlying dispute over whether the expanded system complies with federal law.
The Trump administration modified SAVE to incorporate additional federal records, including Social Security Administration data, and allow searches using Social Security numbers as well as bulk processing of voter information.
The administration maintains that the changes make it easier for state and local election authorities to verify the citizenship status of registered voters and people seeking to register.
However, the League of Women Voters, the Electronic Privacy Information Centre, and other challengers have argued that the modifications exceed the federal government’s authority and raise privacy and accuracy concerns.
They have also raised concerns that eligible US citizens could be incorrectly identified as noncitizens because of errors or incomplete information in government databases.
Court filings show that some individuals have previously been incorrectly identified as noncitizens through the modified system, an issue cited by opponents in challenging its expanded use.
The administration, however, argued that restricting the database would interfere with the federal government’s ability to respond to requests from states seeking citizenship information for voter-registration purposes.
The dispute forms part of a wider legal and political debate in the United States over citizenship verification, voter-roll maintenance and the federal government’s role in election administration.
With the Supreme Court’s latest action, the expanded SAVE system can continue operating while courts consider the broader legal challenge.
